1. Who we are and what this covers
Hasht LLC, a Texas limited liability company ("Hasht LLC", "we", "us"), builds the hasht open-source chat software with messaging, file sharing, voice calls and video calls. These Terms of Service ("terms") are an agreement between you and Hasht LLC, and they apply when you use:
- Hasht Cloud — our hosted chat service at chat.hasht.net;
- hasht for iOS and Android (the "hasht-app" mobile apps) and hasht for macOS, Windows and Linux (the "hasht-desktop" apps), together the "apps";
- services we operate for the apps and for self-hosted servers, such as the mobile push relay; and
- our website at hasht.net.
We call all of these the "services". By using them you agree to these terms. Our Privacy Policy explains how we handle personal information and is part of how we provide the services, so please read it too.
These terms do not cover servers run by other people. If you use the apps with a self-hosted server, that server's operator is responsible for it, and their own terms and privacy policy apply. See Open source and self-hosting.
If we offer paid features in the future, any additional terms will be presented to you before you buy.
2. Your account
Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to create a Hasht Cloud account, consistent with the Children section of our Privacy Policy. If you are under the age of majority where you live, you confirm that a parent or guardian has agreed to these terms. You may not use Hasht Cloud if we have previously banned you, or if the law prohibits you from using it.
Keeping your account safe
Give us accurate sign-up information, keep your password private, and tell us promptly at [email protected] if you think someone else has accessed your account. You are responsible for activity on your account. Don't sell, share or transfer your account, and don't create accounts by automated means or to get around a ban.
If you use hasht for an organization
If you create an account or a server on behalf of a company, club or other organization, you confirm that you are authorized to accept these terms for it, and "you" includes that organization.
3. Acceptable use
We want hasht to be a good place to talk. When you use Hasht Cloud or any hasht-operated service, you agree not to post, share or do any of the following:
Prohibited content
- Child sexual abuse material, or any content that sexualizes minors. We report this to the relevant authorities, such as NCMEC, as the law requires.
- Threats of violence, incitement to violence, or content that promotes terrorism or violent extremism.
- Harassment, bullying, or content that attacks people based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability or similar characteristics.
- Intimate images of someone shared without their consent, or someone's private information shared to harm or intimidate them ("doxxing").
- Content that encourages self-harm or suicide.
- Content that infringes someone else's copyright, trademark, privacy or other rights.
- Malware, phishing links, or anything designed to damage devices or steal information.
Prohibited conduct
- Breaking the law, or helping others to, including selling illegal goods or services or engaging in fraud or scams.
- Spam, including unsolicited bulk messages, invite spam, or artificially inflating activity.
- Impersonating another person or organization, or misrepresenting your connection to them.
- Accessing accounts, servers or data you aren't authorized to, or probing, scanning or testing our systems for vulnerabilities outside responsible disclosure to [email protected].
- Disrupting or overloading the services, for example through denial-of-service attacks, excessive automated requests, or abusing our call relays or storage.
- Scraping or harvesting other users' information without their consent.
- Getting around our limits, bans, or the moderation decisions of server admins.
Server admins may set stricter rules for their own servers. These terms set the minimum that applies everywhere on Hasht Cloud.
4. Your content
You own the messages, files, voice messages and other content you post. We don't claim ownership of any of it.
To run the services, you give Hasht LLC a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process and display your content, only as needed to operate, secure and improve the services for you and the people you share it with (for example, delivering a message, generating a preview of a file, or keeping backups). This license ends when your content is deleted from our systems, as described in the Privacy Policy, except for copies others have saved or that we must keep by law.
We do not use your content for advertising, sell it, or use it to train AI models, as our Privacy Policy explains.
You are responsible for what you post, and you confirm you have the rights needed to share it. Content you post in a server or channel is visible to its members, who may copy or forward it, so think before you share.
5. Servers, channels and admins
On Hasht Cloud, anyone can create a server and invite people to it. If you create or administer a server, you are responsible for it:
- Moderation powers — server and channel admins can set rules, manage roles and permissions, delete messages and files, remove or ban members, and set how long messages are kept.
- Your responsibilities — you must run your server in line with these terms, act on serious problems you're aware of, and not use your admin powers to harass members or collect their information for purposes they haven't agreed to.
- Your own rules — you may add community rules for your server, as long as they don't conflict with these terms.
Admin moderation does not replace ours. We may still act on content or accounts in any server that break these terms, and we may remove a server that is set up or run mainly to break them.
6. Reporting abuse
If you see content or behavior on Hasht Cloud that breaks these terms, you can tell the server's admins, and you can always report it to us at [email protected]. Please include links to or screenshots of the content, the server and channel it's in, and the usernames involved. We review reports and decide what action, if any, to take. If you or someone else is in immediate danger, contact your local emergency services first.
We can only act on Hasht Cloud. For content on a self-hosted server, contact that server's operator; we have no access to it.
7. Copyright complaints
We respect intellectual property rights and respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws. If you believe content on Hasht Cloud infringes your copyright, send a notice to [email protected] or by mail to Hasht LLC, Attn: Copyright Agent, 5900 Balcones Drive, Suite 100, Austin, TX 78731, that includes:
- your physical or electronic signature;
- a description of the copyrighted work you believe has been infringed;
- where the infringing material is located on Hasht Cloud, specific enough for us to find it;
- your name, address, telephone number and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
If your content was removed because of a notice and you believe that was a mistake, you can send us a counter-notice with the information the DMCA requires. We may restore the content unless the complainant tells us they have started legal action. We terminate the accounts of repeat infringers in appropriate circumstances.
8. Suspension and termination
If you break these terms
We may remove content, limit features, suspend or terminate an account, or remove a server if we reasonably believe it breaks these terms or the law, puts other people or the services at risk, or exposes Hasht LLC to legal liability. Where it's appropriate and safe to do so, we'll tell you what happened and why, and you can reply to the email we send or write to [email protected] if you think we made a mistake. We may act without notice in serious cases, such as child safety, threats of violence or attacks on the services.
If you want to leave
You can stop using the services and delete your Hasht Cloud account at any time, as described in Deleting your account. Before you do, you can export your data. Uninstalling an app does not delete your account.
What happens after
When an account ends, your right to use Hasht Cloud ends, and we delete your data as our Privacy Policy describes. Sections of these terms that by their nature should continue (such as content you've licensed to others, disclaimers, limitation of liability, indemnity and governing law) continue to apply.
9. Service availability and changes
We work hard to keep Hasht Cloud running, but we don't promise it will always be available, uninterrupted or free of errors. We may need to pause the service for maintenance, upgrades or events outside our control.
We're always improving hasht, so features may change, be added or be removed. If we make a change that significantly reduces what you can do, or if we decide to shut down Hasht Cloud, we'll give you reasonable notice in the app or by email, and time to export your data, unless we have to act sooner for legal or security reasons. Because the software is open source, you can also run it yourself.
Beta and experimental features
Some features may be labeled beta, preview or experimental. They may be incomplete, change without notice, or be removed, and they may not be as reliable as the rest of the service. Don't rely on them for anything critical. Optional AI features, where offered, act only on the content you choose to give them and may produce inaccurate results.
Limits
To keep the service fair and stable, we may set reasonable limits, for example on file size, storage, message rate, call length or the number of servers you can create.
10. Open source and self-hosting
The software is governed by its license
The hasht server, web client and apps are open source. Your use, copying, modification and distribution of the source code is governed by the open-source license in each repository (the MIT License for the hasht chat server), not by these terms. Nothing in these terms limits the rights that license gives you. These terms apply to services we operate, such as Hasht Cloud and the push relay.
Self-hosted servers aren't ours
Anyone can run a hasht server. Hasht LLC does not operate, control, monitor or moderate self-hosted servers, and we are not responsible for them or for the content, conduct or data on them. We can't access, remove or recover anything stored on someone else's server.
If you run a server
If you operate a self-hosted hasht server, you are responsible for:
- your server's users, their content and how they are moderated;
- complying with the laws that apply to you, including data protection, content and law-enforcement obligations;
- publishing your own terms of service and privacy policy for your users; and
- securing and maintaining your server.
Using the apps with other servers
The hasht apps can connect to Hasht Cloud or to any self-hosted server you choose. When you connect to a server someone else runs, your use of that server is between you and its operator. We license the apps to you for that purpose, but we make no promises about third-party servers, and you use them at your own risk.
11. hasht services for self-hosted servers
Some services we run are available to self-hosted servers and apps connected to them, so they work as well as Hasht Cloud:
- Push relay — mobile notifications can only be sent with the app publisher's credentials, so self-hosted servers may send notifications for hasht app users through our relay. The relay forwards notifications to Apple or Google and doesn't keep them after delivery, as described in the Privacy Policy.
- Update checks — the desktop apps check our public releases for new versions.
These services are offered free of charge, as a convenience, and on a fair-use basis. If you operate a server that uses them, you agree to use them only to deliver genuine notifications to your own users, not to send spam, unsolicited or abusive notifications, or traffic that is excessive or disruptive. We may rate-limit, suspend or revoke a server's access to these services if we reasonably believe it is being abused, threatens their stability, or is being used to break the law, and we may change or discontinue them with reasonable notice where possible.
12. The hasht name and logo
The open-source license covers the code, not our brand. The "hasht" and "Hasht Cloud" names, the hasht logo and related marks are trademarks of Hasht LLC and are not licensed under the MIT License or any other code license.
- You may use the hasht name to refer truthfully to the project, for example to say that your server runs hasht, or that your software is based on or compatible with hasht.
- You may not use the hasht name or logo in a way that suggests your server, service, fork or product is made, endorsed or operated by us, or that could confuse people about who runs it. That includes naming a hosted service or a modified app "hasht" or using our logo as its icon.
- If you fork the software and distribute a modified version, please give it a different name and logo.
For any other use, ask us at [email protected].
13. Disclaimers
We provide the services "as is" and "as available". To the fullest extent permitted by law, Hasht LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the services will be uninterrupted, secure or error-free, or that content will never be lost. Keep your own copies of anything important.
We are not responsible for content posted by other users, for self-hosted servers, or for third-party services you connect to. hasht is not an emergency service; don't rely on it to contact emergency services.
Some places don't allow certain warranties to be excluded, so some of these disclaimers may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, Hasht LLC and its contributors, contractors and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue, goodwill or business opportunities, arising from or related to these terms or your use of (or inability to use) the services, even if we were told such damages were possible.
To the fullest extent permitted by law, our total liability for any claim related to the services is limited to the greater of the amount you paid us for the services in the 12 months before the claim, or US $100.
Nothing in these terms limits liability that can't be limited by law, such as liability for fraud, gross negligence, or death or personal injury caused by negligence, and nothing affects rights you have as a consumer that can't be waived.
15. Indemnity
If you use the services for a business or organization, or if your content or conduct breaks these terms or the law, you agree to defend and indemnify Hasht LLC against claims, losses and reasonable costs (including legal fees) brought by third parties that arise from your content, your use of the services, a server you operate, or your breach of these terms. We'll tell you promptly about any such claim and let you participate in its defense. This section doesn't apply to the extent the law where you live doesn't allow it.
16. Governing law and disputes
These terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute arising from these terms or the services will be resolved in the state or federal courts located in Texas, and you and Hasht LLC agree to their jurisdiction. Either of us may instead bring an individual claim in small claims court if it qualifies.
If you are a consumer living in the EEA, UK or another country whose law gives you the right to bring claims in your local courts or under your local law, nothing in this section takes away that right.
Before starting a formal dispute, please contact us at [email protected] so we can try to resolve it informally. Most problems can be sorted out that way.
17. Changes to these terms
We may update these terms as the services and the law change, and we'll revise the effective date above. If a change is significant, we'll notify you in the app or by email before it takes effect. If you keep using the services after a change takes effect, you accept the updated terms; if you don't agree, you can stop using the services and delete your account. Past versions are available in this site's public history on GitHub.
Other legal details
These terms, together with the Privacy Policy, are the whole agreement between you and Hasht LLC about the services. If any part of these terms is found unenforceable, the rest stays in effect. If we don't enforce a part of these terms right away, we haven't waived it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of assets, as described in the Privacy Policy.
